Terms of Service

1. Description of the Service

KELYNS MARKETING - F.Z.E (hereinafter “Kaly”), Free Zone Establishment - Limited Liability, registered under licence number 50052 with the Ajman Free Zone Authority, with its registered office at Office C1-1F-SF6446, Ajman Free Zone, United Arab Emirates, operates the WhatsApp automation platform accessible at kaly-app.com.

By accessing the Service, you unconditionally accept these Terms of Service.

2. Access to the Service

Access to the Service requires creating an account with a valid email address. You are responsible for the confidentiality of your credentials. The Service is reserved for professionals. Kaly reserves the right to suspend any account in case of violation of these Terms of Service.

3. WhatsApp Connection

Connecting your WhatsApp account is done by scanning a QR code. Kaly only accesses conversations initiated via your templates — we have no access to the general history of your WhatsApp account.

Kaly has been designed and developed using proprietary technology that replicates human behaviour, to provide a natural experience that respects platform rules.

WhatsApp applies its own detection algorithms autonomously. Kaly cannot be held responsible for any restrictions applied by WhatsApp to your account. We advise against using Kaly with a recently created WhatsApp account, as these are statistically more susceptible to automatic restrictions.

4. Google Calendar Connection

Connecting to Google Calendar is optional. By authorising access, you allow Kaly to read your events (title, date, time) to trigger automation. You can revoke this access at any time from myaccount.google.com/permissions.

5. Subscription and Billing

• Monthly subscription: €69/month — annual subscription: €49/month
• Payments processed securely
• Automatic renewal unless cancelled before the due date
• No refund for a period already billed, unless required by law

6. Cancellation

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current period. Your data is retained for 30 days after cancellation, then permanently deleted.

7. Acceptable Use

It is prohibited to use the Service to send unsolicited messages, for illegal or fraudulent purposes, to harass or harm others, or to resell access to third parties. Kaly reserves the right to immediately suspend any account in case of non-compliance.

8. Intellectual Property

All elements of the Service (software, interface, brand, content) are the exclusive property of Kaly. Any unauthorised reproduction or exploitation is prohibited.

9. Liability

Kaly cannot be held liable for interruptions related to third parties (WhatsApp, Google), indirect commercial losses, or the content of messages configured and sent by the user through the platform.

10. Force Majeure

Kaly shall not be held liable for failure to fulfil its obligations in the event of an unforeseeable event beyond its control, including: natural disaster, network failure, third-party provider failure, government action, or any other cause beyond the reasonable control of Kaly.

11. Right of Withdrawal

As the Service is intended exclusively for professionals acting within the scope of their business, the right of withdrawal applicable to consumers does not apply.

12. Changes to the Terms

Kaly reserves the right to modify these Terms of Service at any time. In the event of a substantial change, you will be notified by email at least 15 days before the changes take effect.

13. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of the United Arab Emirates. Any dispute shall be subject to the exclusive jurisdiction of the courts of the Emirate of Ajman.
